    • Firstly we would like to express our deepest regret for the inconvenience caused by this unintentional delay in the delivery of the Products you ordered which was due to inevitable circumstances, and we assure that your dissatisfaction has been treated in a serious way.
    • As you know, this incovenience has been caused to you because of distillation we had to perform on the entire material because of the high sulfur values was not planned originally and was based on the process control values.
  • This was completely unpredictable to us and led to this delay.
    • You unilaterraly decided to start your campaign with other material without informing us and without unfortunately letting us know [in writing] of the pecunairy consequences , especillay to the extra cost cleaning - the 30.000, -CHF that would caused you.
    • Anticipation of potential risk consequences is key in our process, and have to be necessarly provided to us by our clients.
    • That is why our Group General Sales conditions clearly stipulate that we need to be fully informed in writing at of the possible loss and damage consequent to delayed delivery and a specific valuation of the different elements thereof.
    • In addition, article 6.8. of the same sets out that we could not be liable for any incidental/conequential damages sustained by the Buyer.
    • Therefore, even though we sincerely regret that we cannot consider the reimbursment of the 30.000, -CHF extra cost cleaning.
    • This is for the first time that we have been unable to execute your orders within the stipulated period.
    • Please be assured that this issue will not take place in the future again, and that we have taken all precautionary steps.
